Bluebonnet Learning Services Terms and Conditions

By booking a tutoring session with Bluebonnet Learning Services (“BLS”), you (the "Client") agree to the following Terms and Conditions. These terms apply to all tutoring services provided by BLS and its independent tutors.


1. DEFINITIONS

  • "Business" refers to BLS, including all affiliated tutors and representatives.
  • "Client" refers to the student or, in the case of minors, their parent or legal guardian.
  • "Tutor" refers to the independent educator providing tutoring services under this agreement.
  • "Session" refers to any booked tutoring appointment, whether in-person or online.

2. SERVICES PROVIDED

2.1 Scope of Tutoring

  • The Business provides tutoring services via in-person and online sessions.
  • Tutors will use their expertise to assist in the learning process but do not guarantee specific academic results.

2.2 Session Duration & Booking

  • Sessions are booked in advance via the BLS booking portal.
  • The Client is responsible for ensuring they attend sessions at the agreed time.

3. PAYMENT & CANCELLATION POLICY

3.1 Payment Terms

  • Payment for tutoring sessions is due before the session via the BLS booking portal.
  • Late payments may result in session cancellation or additional fees.

3.2 Cancellation & Refund Policy

  • 100% refund if canceled at least 24 hours before the session, or if Tutor cancels.
  • 50% refund if canceled within 24 hours of the scheduled session.
  • No refund if the Client does not show up for the session without prior notice.

3.3 Rescheduling

  • Sessions may be rescheduled at least 24 hours in advance without penalty.
  • Rescheduling within 24 hours is subject to Tutor availability and is not guaranteed.

4. LIABILITY & DISCLAIMERS

4.1 No Academic Guarantees

  • The Business and its Tutors provide academic support but do not guarantee grade improvements, test scores, or specific outcomes.

4.2 Limitation of Liability

  • The Business is not responsible for any damages, including but not limited to:
    • Failure to achieve desired academic results.
    • Internet connectivity or software failures during online sessions.
    • Misuse of tutoring materials provided.
    • Personal injuries resulting from in-person sessions.
  • Client assumes all risks related to tutoring services.

4.3 Parental Supervision (For Minors)

    • If the student is under 18 years old, the parent/guardian is responsible for:
      • Ensuring a safe study environment.
      • Supervising online sessions as necessary.
      • Supervising at-home sessions.
    • Tutors will not be held liable for any misconduct by minors during sessions.
  • Client or another guardian must be present for at-home sessions- Absence of guardian will result in meeting cancellation without a refund.

5. DATA COLLECTION & PRIVACY POLICY

5.1 What Information We Collect

  • We collect basic personal information including:
    • Student’s Name, Age, Subjects (for educational purposes).
    • Parent/Guardian’s Contact Information (for communication & scheduling).
    • Payment Details (if applicable).

5.2 How We Use Your Information

  • Contact details are used for session confirmations, rescheduling, and service updates.
  • Personal information is never sold or shared with third parties.
  • Tutors may keep notes on student progress, which remain confidential.

5.3 Data Security

  • The Business takes reasonable measures to protect stored personal data, but cannot guarantee absolute security due to external factors (e.g., hacking).

6. CODE OF CONDUCT

6.1 Client Expectations

  • Clients and students must:
    • Be respectful during sessions.
    • Arrive on time for scheduled tutoring.
    • Use tutoring resources only for educational purposes.

6.2 Tutor Rights

  • Tutors reserve the right to terminate a session immediately if the student engages in:
    • Inappropriate behavior (e.g., harassment, discrimination, disruptive conduct).
    • Academic dishonesty (e.g., requesting tutors to complete assignments).
    • Failure to adhere to agreed policies.
  • If a session is terminated for misconduct, no refund will be issued.

7. DISPUTE RESOLUTION

7.1 Good Faith Resolution

  • If a dispute arises, the Client and the Business agree to first attempt informal resolution via discussion.

7.2 Mediation & Legal Action

  • If the dispute remains unresolved, it may proceed to mediation in Texas before legal action is considered.
